Terms of Service
These terms cover the OpenMOM software, its public repository scheduled for January 2027, this website (openmom.org), and the documentation published on it. They are written to be read, not to trap you: the software itself is governed first and foremost by the Elastic License 2.0; the license published with the repository will be authoritative.
1. Acceptance of these terms
By using OpenMOM — the software, this website, or the documentation — you agree to these Terms of Service. If you do not agree with them, please do not use the software or the site. These terms apply to everyone who uses OpenMOM: individuals, businesses, and organizations alike.
2. Elastic License 2.0 governs the software
The OpenMOM core is source-available software licensed by Big Decibel LLC under the Elastic License 2.0. The license text published with the repository will be the authoritative statement of your rights in the software and will govern over anything in these terms.
ELv2 grants a non-exclusive, royalty-free, worldwide license to use, copy, distribute, make available, and prepare derivative works of the core, subject to its limitations and conditions. Those limitations are material:
You may not provide the software to third parties as a hosted or managed service where the service provides access to any substantial set of its features or functionality.
You also may not circumvent license-key functionality, remove protected functionality, or alter, remove, or obscure licensing, copyright, or other licensor notices. Anyone receiving a copy must receive the license terms, and modified copies must carry a prominent modification notice. Where these terms conflict with ELv2 as it applies to the software, ELv2 takes precedence.
As far as the law allows, the software comes as is, without any warranty or condition, and the licensor will not be liable for damages arising from these terms or from the use or nature of the software, under any kind of legal claim.
One boundary worth knowing: the commercial/
directory of the repository is proprietary and is not covered by ELv2. It carries its
own separate commercial license and is excluded from core distributions.
3. The website and documentation
This website and the documentation are provided in the same spirit as the software: you are welcome to read them, follow their links, and use the information in them freely. They are provided as-is, without any promise that they are complete, current, or error-free. Where the site describes what OpenMOM does or how legacy MOM behaves, the verified implementation and compatibility matrix are the current source of truth; the repository becomes authoritative when it opens in January 2027.
4. No warranty for the software
Consistent with ELv2, OpenMOM is provided without warranty of any kind — no warranty of merchantability, no warranty of fitness for a particular purpose, and no warranty of non-infringement, whether express or implied. You assume all risk as to the quality and performance of the software. If it turns out to be defective, you bear the cost of any necessary servicing, repair, or correction. Run your own tests, keep your own backups, and roll it out at the pace your business can stand.
5. Limitation of liability
To the maximum extent permitted by applicable law, Big Decibel LLC — together with the OpenMOM authors and contributors — will not be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the software, this website, or the documentation. This mirrors the liability disclaimer in ELv2 quoted in section 2.
6. Your use
You are responsible for your deployments, your data, and your compliance with the laws that apply to you — including privacy, tax, consumer-protection, and payment-card rules for the orders you process. OpenMOM gives you the tools; running them properly is your job.
Don't use OpenMOM or this website for unlawful purposes. Don't attempt to disrupt, overload, or gain unauthorized access to this site or its infrastructure, and don't scrape or automatedly hammer the site in a way that degrades it for everyone else.
7. Third-party services
This site links to third-party properties, including Enabley, the separate commercial cloud for OpenMOM operated by the same team. Those services have their own terms and privacy practices, which govern your use of them. A link from this site is a convenience, not an endorsement, and we are not responsible for third-party content or services.
8. Changes to these terms
We may update these terms from time to time. The effective date at the top of this page always reflects the current version. Changes take effect when published here, and your continued use of the software, the site, or the documentation after that constitutes acceptance of the updated terms.

Trademark Notice & Legal Exception
"MOM" (as in MultiChannel Order Manager), "Freestyle Solutions", and "Dydacomp" are names and marks belonging to their respective owners — Freestyle Solutions / Dydacomp being the historical vendors of the legacy MOM product.
Their use on this site and in OpenMOM's documentation has no relationship with Big Decibel LLC, Enabley, or OpenMOM. Big Decibel LLC does not own the copyright or any rights to those names. They are used purely for reference — to identify and describe the legacy software that OpenMOM is compatible with and replaces.
No intellectual property or licensing from those products or marks has been used to create OpenMOM or Enabley. OpenMOM is an independent, ground-up implementation. Where legacy behavior is described, it comes from public, observable documentation and from reverse engineering for interoperability — not from any licensed or copied material. Read about how the project was actually built.
